1. Acceptance of Terms

By accessing or using Cachea (“the Service”), provided by Tresseo, you agree to comply with these Terms of Service, our Privacy Policy, and Cookie Policy. If you do not agree, do not use the Service.

2. Permitted Use

You may save, organize, and read web articles using Wallabag. You are permitted to use API tokens for authorized third-party integrations when enabled. However, you may not host, upload, or share illegal content, including but not limited to illegal pornography or content that constitutes hate speech as defined under EU laws. Additionally, you may not engage in activity that abuses our resources, such as excessive usage of CPU/RAM that may adversely affect other users.

3. Content Responsibility

You are solely responsible for any content you save or manage through Cachea. Cachea reserves the right to remove any content that violates applicable laws or these Terms of Service, with notice provided where practicable.

4. Fair Use & Storage Limits

Cachea operates on a fair-use model with generous article limits designed for flexibility and convenience. The Casual Reader plan allows for the storage of approximately 10,000 articles, accommodating your daily reading habits effectively. The Power User plan provides capacity for approximately 30,000 articles, supporting extensive research and frequent use. These limits will increase over time.

These limits are established to ensure seamless usage without immediate enforcement actions. While we do not actively monitor individual article counts, reviews may be conducted if system resources are significantly impacted or in instances of substantial deviations from typical usage patterns—such as users exceeding 10 times the average use in any given week.

In such instances, you will receive a 14-day notice if urgent adjustments are necessary to your account. When nearing these article limits, we will work with you to explore options such as upgrading your plan or archiving older articles, ensuring continuous access and preventing unexpected interruptions due to exceeding article capacities. Our focus remains on sustaining fair and uncompromised access for all users.

5. Termination & Suspension

We may suspend or terminate your access to the Service for immediate termination if you store illegal content or hate speech. In cases of resource abuse, we will provide a 24-hour notice for problem resolution. Immediate suspension will occur for payment chargebacks, which may result in account termination at our discretion.

6. Payments & Refunds

Full refunds are available within 3 days of payment, applicable to credit card and e-transfer transactions only. Chargebacks will result in immediate service suspension and may lead to a permanent ban from future access to Tresseo services.

7. Data Protection (GDPR Compliance)

We process personal data in accordance with the GDPR and our Privacy Policy. You have the right to request access to or deletion of your personal data by contacting support@cachea.app. By using this Service, you consent to necessary cross-border data transfers required for service provision.

8. Limitation of Liability

Tresseo and its affiliates are not liable for any indirect or consequential damages, including but not limited to loss of data or service interruptions and legal consequences arising from the content you save.

9. Changes to Terms

We may update these Terms from time to time. Updates might be communicated via email or a notification on your user dashboard. Continued use of the Service after any changes constitutes acceptance of the new Terms, regardless of whether you received notice of any update. It is your responsibility to revisit this page to ensure your use is compliant with our terms.

10. Governing Law

These Terms are governed by the laws of the Province of Ontario in Canada. Any disputes related to these Terms will be resolved in the courts located in Ottawa, Canada.

11. Security and Cybersecurity Practices

We ensure that data is encrypted both in transit and at rest using industry-standard encryption protocols. Access to your data is restricted to authorized personnel only under our strict data access policies. In case of a data breach, we are committed to providing prompt notifications as per GDPR and PIPEDA requirements.
